Here is a new fraudulent transfer case out of California. It is interesting to note that the trend lately is for plaintiffs to include a civil conspiracy claim. This should be a warning to all with fiduciary duties to clients....don't conspire with them to break the law! We're seeing a big increase in attorney after planner, after trustee, after CPA fighting civil conspiracy claims. This should also be a wake up call for the "do-it-yourself" asset protection guru. Asset protection is such a broad and complex topic. That is why good planning involves a TEAM of professionals working together. Beware the courts are cracking down!
